Terms of Use for SHAPE America Journals
These terms of use supplement the privacy policy that appears on the Society of Health and Physical Educators (SHAPE America) website (www.shapeamerica.org). As such, it omits various points already covered in that document and modifies others. References to the “site” in that policy should be regarded as applying equally to SHAPE America’s journals. Persons interested in such terms and conditions as jurisdictional issues, warranties, limitation of liability, and others – as they apply to SHAPE America journals – should consult SHAPE America’s privacy policy.
Copyright and Fair Use
Copyright in the journals is held by SHAPE America and is protected under U.S. copyright law. Except for the “fair use” limitations provided by U.S. copyright law, content from the journals may not be modified, transmitted, recompiled, used to prepare derivative works, incorporated into databases, republished, or reproduced, in whole or in part, in any format without permission from SHAPE America or specified copyright holders (as in the case of some photographs).
Access by Authorized Users
The full text of online journal content may be accessed only by authorized users. Current SHAPE America members are provided access based on their membership status. SHAPE America members are defined as bona fide accredited individual members, which definition shall exclude all other entities including but not limited to university, institutions of higher and further education, colleges, schools, libraries, corporate, commercial, and for-profit entities, registered charities and not-for-profit entities, government entities and agencies, international entities and agencies, non-governmental entities and agencies. Taylor & Francis (journal publisher) shall offer the journals for sale to such excluded entities. Additional authorized users include individual online subscribers; persons who purchase access to the journal content through an aggregator licensed by SHAPE America; individuals who purchase one or more articles via the Taylor & Francis website; and persons authorized to access the content due to their affiliation with a subscribing institution as a current student, faculty member, employee, or library patron who is physically present in the library or on the campus.
Online access cannot be transferred, rented, or sold, in whole or in part, to another party.
Printing of Copies or Photocopies
Authorized individual users may print one copy, or make a photocopy, of an article for their personal, noncommercial use.
Consortia and Multicampus Access
Access to the journals via an online institutional subscription is restricted to the authorized users of a single campus of a single institution, exclusive of any distance-learning program. All IP addresses connected with a distance-learning program should be collected and registered as a separate site under a separate subscription.
SHAPE America does not currently offer consortia or multicampus pricing. Please contact Taylor & Francis for more information.
Interlibrary Loan
Interlibrary loan of printed journals is permitted, but loan of electronic copies is prohibited. The loan of single photocopies of articles, by post or facsimile transmission, for individual noncommercial use is permitted.
Electronic Course Packets
The use of journal content in electronic course packets for authorized users of a subscribing institution is permitted.
The use of such content in electronic course packets in non-subscribing institutions requires permission and payment of a fee. Application can be made to Taylor & Francis at https://taylorandfrancis.com/contact/rights-and-permissions/.
In all cases, electronic course packets must be protected from access by unauthorized users.
Perpetual Access
Perpetual online access is not provided. Members who do not renew, or subscribers who stop subscribing, lose online access to all issues, including those previously covered by their membership or subscription. However, members and subscribers may archive electronic copies in accordance with the provisions in the next paragraph.
Archiving of Electronic Copies
During the term of their membership or subscription, members and subscribers may archive electronic copies on their own server, at their own expense, and only for their own use.
Individual members and subscribers may not distribute archived electronic copies in any way, either through electronic or printed means. Institutional subscribers may give authorized users access to archived electronic copies.
Reprint Permission
Contributors to the journals may reprint their work in collections or books of their own authorship without payment of a fee, provided they first apply to SHAPE America and/or Taylor & Francis for permission. Use of their work in anthologies or other multiple-author publications requires permission from Taylor & Francis and payment of a fee. Neither authors nor other persons or entities may post journal content on unrestricted websites. In other words, authors may not post their articles on their own web sites, blogs, or university websites that are open to the public.
The use of journal content in course packets in paper format requires permission and payment of a fee. Application can be made to Taylor & Francis at https://taylorandfrancis.com/contact/rights-and-permissions/.
All other uses of journal content require permission and payment of a fee. Application should be made to SHAPE America and/or Taylor & Francis.
